Various state institutions such, including correctional centers, institutions for the developmentally disabled, and schools, buy some food items themselves from local vendors, particularly fresh produce on a weekly basis.  After producers get registered as certified SBSA vendors, they should contact the business offices of any State institutions in their area if they have produce to sell.

Because the State is responsible for sustaining the health and well-being of persons who are their wards, most state purchases require that food items be appropriately inspected or graded.  For example, meat and eggs sold under contract must be USDA graded and stamped.

FOCUS Information for Schools & Institutions: The USDA Food Ordering and Customer Service (FOCUS) Team welcomes State Distributing Agencies that administer the Food Distribution Program for schools and institutions.

FARM TO SCHOOL

SELLING TO USDA

A Step-by-Step Guide for New Vendors

  • Visit the AMS Commodity Procurement Division website and review the various products purchased by the USDA for domestic food assistance programs. A link to product specifications is on this webpage.
    - Questions regarding product specifications may be directed to: CP Division Administrative Operations Branch at 202-720-7693.
  • Read the AMS Master Solicitation for Commodity Procurements (PDF), and the Vendor Qualifications Requirements (PDF) document.
    - Questions regarding these documents may be directed to the CP Division Contracting Branch at 202-720-4159.
  • Download the Vendor Registration Form (PDF) , and send the completed form to AMS via e-mail. This form grants an applicant limited access to the Web-Based Supply Chain Management System (WBSCM), but does not approve the applicant to participate in USDA purchases.
  • An e-mail will be send to the applicant indicating that they need to set up an e-Authentication account with a user ID and password, and then complete registration in the WBSCM system. Level 1 access into e-Authentication allows the applicant to enter WBSCM and submit the necessary qualifications documentation.

Once the necessary documents are submitted, the Contracting Officer will approve or deny the applicant access to the bidding process. If approved, the new vendor is give a Corporate Vendor Administrator role and a Vendor Offer role, and may now submit bids. If the applicant is denied, the reason(s) for denial will be provided, and the applicant will need to correct the issue(s) before being granted access.

USDA Commodity Food Network
For vendors, food processors, or small business entrepreneurs that want to know how to sell fresh and processed products to USDA for distribution to eligible recipients participating in the USDA Food Distribution Programs.  

To sell to the USDA: FNS's Food Distribution Division works closely with the following two USDA agencies that are responsible for purchasing commodities for the FNS Food Distribution Programs:

  • The Agricultural Marketing Service (AMS), which is responsible for purchasing Group A-Type products that include beef, fruits & vegetable, pork, fish, poultry & egg products
    • AMS Commodity Procurement Division: AMS Commodity Procurement Division purchases a variety of food products in support of the National School Lunch program and other food assistance programs. These purchases also help to stabilize prices in agricultural commodity markets by balancing supply and demand.
  • The Farm Service Agency's (FSA) Commodity Operations Office, which purchases dairy products and other domestic processed products such as  bakery mix, crackers, cornmeal, flour, fortified cereal, macaroni & cheese, pasta products, peanut products, rice, shortening, & vegetable oils, etc.

Commodity Food Network Vendor Qualification and Bid Procedures: Information about the requirements for vendors and processors to sell products to USDA and the how they may register online via the USDA Domestic Electronic Bid Entry System (DEBES).

AMS Poultry Program: The mission of Poultry Programs is to facilitate the strategic marketing of products of the poultry and egg industries in domestic and international markets and, through various programs and services, promote a competitive and efficient marketplace that benefits U.S. producers and consumers.

AMS Livestock and Seed Commodity Procurement: Red Meat and Fish products are purchased by the Livestock and Seed Program's Commodity Procurement Branch.. which endeavors to provide high-quality products and customer service.

AMS Commodity Procurement : Purchases a variety of food products in support of the National School Lunch program and other food assistance programs.

SELLING TO THE ILLINOIS STATE INSTITUTIONS

The best way for farmers and producers to sell their products to state institutions is to get registered to receive notification of procurement opportunities that are posted on the Illinois Procurement Bulletin. This site also contains lots of helpful information about current contracts and previous bids for eggs, meat, chicken, and other types of food.

Before selling, suppliers should follow these steps:

1. Register on the Illinois Procurement Bulletin (IPB)
Register to electronically receive email notifications and download postings from the Illinois Procurement Bulletin. Each employee of a company must individually register. Go to Illinois Procurement Bulletin Registration.

  • Employees of companies can individually register on the IPB to electronically (via email) receive and download postings.
  • Employees of companies can identify area(s) of commerce for their business, by selecting specific commodity/service class code(s) to receive e-mail for any procurement activity in their designated class code(s).
  • Employees of companies can chose the type of postings to receive by indicating either Both, Solicitation Only, Notices Only or None.
  • Employees will only receive e-mail notifications under the class code(s) they designate and the types of notifications selected.

2: Apply for Small and Diverse Business Programs

To apply for the Small Business Set-Aside Program (SBSP) and/or Business Enterprise Program (BEP) complete the following forms. You can participate in both programs if you meet each program’s requirements.

There are two recent Public Acts of which all State vendors and their attorneys should be aware. We encourage you to read these Acts in their entirety.
Public Act 96-795 makes significant revisions to the Illinois Procurement Code and places new requirements on vendors and bidders. Public Act 95-971 establishes certain registration requirements and campaign contribution restrictions for State vendors and bidders. SELLING TO ILLINOIS PUBLIC UNIVERSITIES

Steps to sell to Universities:
All vendors who wish to bid on Illinois public university contracts must:

1. Be a legal entity authorized to do business in Illinois in conformance with the Illinois Secretary of State.

Vendor/Bidders may qualify to submit bids or proposals to state universities of Illinois only if they are a legal entity authorized to do business in Illinois prior to submitting the bid, offer or proposal. This applies to both in-state and out-of-state firms.

A Vendor/Bidder must be:

  • a legal entity
  • registered to conduct business in Illinois
  • in good standing with the Illinois Secretary of State

Specific information regarding compliance can be obtained from (30 ILCS 500/1.15.80, 20-43). Please contact the Illinois Secretary of State for additional information.

In-State Firms
Corporations (Corp); Limited Liability Companies (LLC); Limited Partnerships (LP); Limited Liability Limited Partnerships (LLLP) - Please contact the Illinois Secretary of State for further information.

Sole Proprietorships - If the firm's name is the same as the sole proprietor's name, nothing is required.

All Out-of-State Firms - A foreign vendor is defined as any vendor who has not incorporated within the State of Illinois. A Guide for Qualifying Foreign Corporations, published by the Secretary of State, will answer your questions on how to qualify your Corporation/LLC to do business in Illinois. Please direct your questions to the Illinois Secretary of State.

2. Register with the Illinois State Board of Elections and obtain from them a certificate confirming your registration (applies if you do $50,000 worth of business annually, including the business you do with all state of Illinois agencies and the value of the current project that you are bidding).

Listed below are some of the critical requirements of the Public Act 095-0971, which apply to all types of vendors except for not-for-profit organizations and governmental entities. There are no exceptions for out-of-state or non-U.S. vendors.

If either of these conditions apply:

  • You are submitting a bid or proposal exceeding $50,000 on any state university procurement solicitation, Or
  • The bid or proposal you are submitting is less than $50,000 but the annual total value of all of your contracts and offers with all State agencies (including all current State contracts, the bid or proposal you are submitting, any other pending offers, and offers you previously submitted this year where you were not awarded a contract) exceeds $50,000,

You must take both of the following actions:

  1. Obtain a certificate of registration from the Illinois State Board of Elections. And
  2. Include a copy of the registration certificate with your bid or proposal.

If a bid or proposal from a vendor who is required to register with the Board of Elections is not accompanied by a copy of the registration certificate, the bid or proposal cannot be accepted by the state university. There is no grace period allowing for registration with the Board of Elections after bid opening.

Specific information on how to submit the registration certificate with a bid or proposal will be provided in each solicitation issued by a state university.

3. Hold a current Illinois Department of Human Rights (IDHR) Bidder Eligibility Number (IDHR numbers 89999-00-0 or lower expired on August 31, 1999).

Vendors must have a current Illinois Department of Human Rights (IDHR) Bidder Eligibility Number to be eligible for the award of public contracts.
To register or renew, you must file an Employer Report Form (PC-1) with the IDHR Chicago office:
a) Access and complete the Employer Report Form (PC-1) online.
b) Contact IDHR by Email at IDHR.PublicContract@illinois.gov or call IDHR at (312) 814-4335.

4. Register for an Illinois Public Higher Education Bulletin My Bulletin account if you wish to download solicitation documents, receive E-mail notifications of opportunities, and more.
